Step by Step - How the Italian Citizenship Works Through the Judicial Process
1 - Establishment of the Documents Folder in the Country of Residence:
– Search for all necessary documents: birth, marriage, divorce, naturalization and death certificates of all relatives belonging to the Italian family lineage, all in full;
– Detailed preventive analysis of each certificate to identify whether there is a need to rectify any data;
– Full sworn translation of all certificates;
– Apostille of all certificates and also of sworn translations of certificates;
– Sending the complete documentation (folder) to Italy.
2 - Italian Court and Transcription of Civil Documents:
– Distribution of the Process: After receiving the document folder in Italy, the process will be recorded;
– Process Number: After the protocol we will wait for the issue of the process number, on average 25 days;
– Online monitoring of the Process through the “Civil Justice” application (mobile phone) or via the web (we will send you the link);
– Appointment of the Judge: The selection of the Judge can take up to 3 months and depends exclusively on the Court;
– Court Hearing: After choosing the Judge, he will set the date of the Court Hearing, which can last on average from 6 to 18 months;
– Sentence: After the hearing, the documents remain with the Judge, who can issue the sentence for an average of 30 to 60 days;
– Appeal: After the sentence has been issued, the opposing party has 30 days to appeal. After this period, without appeal, the sentence will be considered final. With the final judgment ALL APPLICANTS IN THE PROCESS WILL BE CONSIDERED ITALIAN CITIZENS;
– Certificate of Final Judgment: Must be requested 30 days after the sentence is considered final. With this document it is possible to transcribe (record) the sentence in the competent municipality;
– Transcription of Civil Documents – Italian Civil Registry: The Municipality will have up to 180 days to transcribe the civil documents (birth and/or marriage) of all applicants. Submit divorce documents, if any, at this time;
– A.I.R.E. Update: Immediately after transcription, all applicants must register with the A.I.R.E., which is the official registry of all Italians residing abroad;
– Issuance of the Italian Passport: After registering with the A.I.R.E., all applicants, now ITALIAN CITIZENS, will be able to request an Italian passport.
